Breaking News: Chris Drury has not been put on waivers and can not be bought out this week
Well, the saga continues. 12:15pm EDT hit and the Ranger beat writers broke the news over twitter that Chris Drury was not put on waivers which means that he could not be bought out by the Rangers. For those of you who don't remember how we got to this point, it started with rumors swirling that Glen Sather will buy out the team's captain to give the team more cap space to spend on UFAs and RFAs.
Then news broke that Chris Drury could not be bought out because of a degenerative knee problem that will probably force him to not play next season.
Now the reports were that Drury was thinking of accepting a buy out instead of being put on LTIR in September.
Per the buy out rules, players that were to be bought out would have needed to be put on irrevocable waivers and would then be bought out of his contract.
There is a second buy out period in August that the Rangers can use to try and buy out the captain

A couple thoughts on the "Drury Trade" talk
1. Doesn’t he need to pass a physical to be traded? If he’s unfit to be bought out, isn’t he unfit to be traded?
2. Does he have added advantage to a club looking to get to the floor? Obviously, it’s a 7 mil hit for 5 mil, but does insurance chip in when he doesn’t play?
On 1- That’s why it’d have to be a team (literally) desperate to get to the cap floor. They’d trade him specifically to put him on LTIR while having his full hit count for the purpose of reaching the floor. It’s really shady, but a team may not care about the physical in that case. Of course, the NMC is the pesky part.
I think you’re right on 2, but have no clue for sure.

More on 1 – I understand that they’d be doing it just to put him on the LTIR, and the team would know he was hurt. I was wondering more if passing the physical was required by the league for the league to approve the trade. Make sense? If Dru’s going somewhere that he’s not expected to play, the NMC shouldn’t be a problem, since they can probably let him "rehab’ on his own, right?

In the latest round of hypothetical “trade talk” it seems more about finding teams looking for his cap hit. If Dru knows he can get paid, and has no chance of playing for us, why wouldn’t he take it. He probably doesn’t even have to move.

Waiver period Monday thru Friday is 24 hours. Other days it increases to 48 hours.
A player with a NMC must be notified of the intention by the Club to place him on unconditional waivers and the club can notify of the intention to buy out.
Player has the option to be placed on unconditional waivers (in other words, a limited waiving on the player’s part of the NMC). He has 24 hours to make the decision.
So the way I understand it – he could have been notified of the intention by the NYR today by noon. He has 24 hours to decide. The Rangers can place him on unconditional waivers by tomorrow @ noon, which expire in 24 hours. If by Noon on Thursday he has not been claimed, the buyout can proceed provided they file by 5PM (also on Thursday).
And I was incorrect on waivers in the other thread – everything else the NHL does is 5PM New York time – except for freakin’ waivers. Why it’s different – who knows…
11.8 (b) of CBA
is the relevant section.
(b) A no-move clause may prevent the involuntary relocation of a Player,
whether by Trade, Loan or Waiver claim. A no-move clause, however, may not restrict
the Club’s buy-out and termination rights as set forth in this Agreement. Prior to
exercising its Ordinary Course Buy-Out rights pursuant to Paragraph 13 of the SPC
hereof, the Club shall, in writing in accordance with the notice provisions in Exhibit 3
hereof, provide the Player with the option of electing to be placed on Waivers. The
Player will have twenty-four (24) hours from the time he receives such notice to accept or
reject that option at his sole discretion, and shall so inform the Club in writing, in
accordance with the notice provisions in Exhibit 3 hereof, within such twenty-four (24)
hour period. If the Player does not timely accept or reject that option, it will be deemed
rejected.
So, if he rejects the option of being placed on waivers, NYR can proceed with Buyout tomorrow.
Subtle language across different sections/sub-sections, but that’s the way I read it.
13.21
is the section dealing with Waivers for ‘contract termination’.
13.21 (a) When a Club desires to terminate a Player’s SPC for any reason, such
action may not be taken until Unconditional Waivers have been requested and cleared in
conformity with this Article. Notwithstanding this provision, a Player with a no-move
clause shall have the rights set forth in Section 11.8.

One addition
The 24 hour waiver period does not have to be completed fo rthe buy-out to start (i.e. for the NYR to file).
So they can notify him tomorrow (Wed) before noon, giving him 24 hours to decide if he wants to go on waivers. If he does, the NYR can file the waiver before noon, and the buy-out before 5PM.
When the waiver expires (Friday noon), he’s a UFA and has been bought out.
If it goes down that way.
Maybe FLA will claim him off waivers ?

So it appears that they notified him no later than yesterday (if I had to guess it probably was earlier than that) – he took time to think about it, and gracefully bowed out by rejecting the waiver opportunity – allowing the buy-out to happen.
It was going to happen one way or the other – and if I had to guess, he wants to control his destiny, as opposed to being cap fodder for a team that needs to reach the floor. Costs the NYR some $$$, but it ends up being a win-win across the board.
